These terms apply to your use of this website, operated by Leadership Resources and Consulting, LLC ("LRAC," "we," "us"). By using the site, you agree to them. If you don't agree, please don't use the site.
1. Using the site
You may use the site only for lawful purposes. Don't try to damage or disrupt the site, get unauthorized access to it or the systems behind it, or use it to send spam or harmful code.
2. Intellectual property
The site's original content belongs to LRAC or its licensors. You're welcome to view it and download it for your own non-commercial reference. Any other use needs our written permission.
Everything DiSC®, Catalyst™, and related names, marks, and materials belong to John Wiley & Sons, Inc. LRAC uses them as an Everything DiSC Authorized Partner.
3. Prices, quotes, and orders
Prices on this site follow Wiley's published pricing and may change. Estimates from the quote tool are for planning only. Information on the site isn't a binding offer; an order is confirmed only by a written quote or invoice from us, and the terms on that quote or invoice govern the purchase. Assessments are delivered on Wiley's online platforms, such as Catalyst™, and Wiley's terms also apply to their use.
4. No professional advice
Content on this site is general and educational. Everything DiSC® assessments are tools for development and conversation. They shouldn't be the only basis for hiring, promotion, or other significant decisions, and you're responsible for using them appropriately and in line with applicable law.
5. Links to other sites
The site may link to sites we don't control, such as Wiley's. We aren't responsible for their content or practices, and you use them at your own risk.
6. Disclaimer of warranties
The site is provided "as is" and "as available," without warranties of any kind, to the fullest extent the law allows. We don't guarantee that the site will be accurate, complete, or available without interruption.
7. Limitation of liability
To the fullest extent the law allows, LRAC isn't liable for indirect, incidental, special, or consequential damages, including lost data, profits, or business, arising from your use of the site. Our total liability for any claim related to the site is limited to the greater of the amount you paid us in the 12 months before the claim or one hundred U.S. dollars. This doesn't limit liability for gross negligence, fraud, intentional misconduct, or anything else that can't be limited by law.
8. Indemnification
You agree to defend and indemnify LRAC against claims arising from your misuse of the site, your violation of these terms or the law, or your violation of someone else's rights. This doesn't apply to claims caused by our own gross negligence, fraud, or intentional misconduct.
9. Disputes
If a dispute comes up, please contact us first so we can try to resolve it informally. Any dispute that isn't resolved will be settled by binding arbitration on an individual basis, except that either of us may bring a qualifying claim in small-claims court. You and LRAC each waive the right to bring or join a class, collective, or representative action. If this section can't be enforced for a particular claim, that claim will be heard in the state or federal courts in Texas.
10. Copyright concerns
If you believe something on this site infringes your copyright, send us a notice through our contact form that describes the work, where it appears on the site, your contact information, and a statement that you believe in good faith the use isn't authorized. We'll respond as required by the Digital Millennium Copyright Act.
11. Suspension
We may suspend or end access to the site at any time, including if these terms are violated or the site is discontinued. Sections that by their nature should continue, such as limitation of liability and disputes, will continue.
12. Other terms
If part of these terms can't be enforced, the rest stays in effect. These terms and our privacy policy are the entire agreement about your use of the site. Not enforcing a provision doesn't waive it.
13. Changes to these terms
We may update these terms and will post changes here with a new effective date. Using the site after a change means you accept the updated terms.
14. Governing law
These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Subject to the disputes section above, you agree to the jurisdiction of the state and federal courts in Texas.
